Metro Agrees to Settlement in Sheriff’s Office Overtime pay Dispute

Despite handling overtime wage cases in Tennessee and through out the country it can still be surprised by people that violate the law. In one recent case, the Metro government has reached a settlement with a former Davidson County Sheriff’s Office official who was terminated after raising questions about why some employees weren’t properly paid for working overtime. The settlement of $37,500 is awarded to Jeanette Porter, a former assistant director of the office’s human resources division.

According to the settlement, Porter in December of 2010, reported to her direct supervisor and others that some Sheriff’s Office employees had failed to receive their overtime pay. At that time no action was taken by any Sheriff’s Office employee, including Porter, to pay the owed overtime, although the problem was addressed later. Then in July of 2012, Porter tried to report the information to attorneys. Following this, the Sheriff’s Office then “began investigating Porter’s conduct”. Porter was later terminated.

The settlement will go before the Metro Council for approval Tuesday, December 3, 2012. The settlement will raise questions about how the city handles overtime and could play a role in a lawsuit over Sheriff’s Office overtime that is pending in federal court.
