Tennessee’s CCA sued for failure to pay overtime to Kentucky employees

Six private prison supervisors have sued Corrections Corporation for America for failing to pay overtime wages. Specifically, the case alleges that CCA denied meal breaks, required employees to attend training sessions off the clock and failed to pay overtime wages.

Requiring an employee to work off the clock is a common practice we see in our office. Often, employees see it as an annoyance but don’t think much about it as may just constitutes a few dollars here and there. From the employer’s perspective, however, requiring an employee to work off the clock can add up to thousand of dollars when it is a company wide practice. As such, a company wide policy is really nothing more than stealing wages from hard working employees to increase profits. If this is in fact what happened to the CCA employees, then all of the wages and appropriate damages should be awarded against this company. Under the Fair Labor Standards Act damages could include double the pay owed and attorney’s fees.
